1. The agreement

These Terms of Service are an agreement between you and Tobie LLC ("Tobie", "we", "us"), the maker of FusionCraft. They cover the FusionCraft game in every form we offer it (including the browser version and, when released, the iPhone and Android apps), this website, and the shared-world services behind them (together, the "Service").
By playing FusionCraft or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are not old enough to form a binding contract where you live, you may use the Service only if a parent or legal guardian agrees to these Terms on your behalf.
2. The service

FusionCraft is a word-crafting discovery game played in one shared world of 12,729 ideas. Playing the Service requires no account, no sign-in, and no personal information; an anonymous identifier generated on your device connects your discoveries to a derived display name (for example, "Crafter 4B7C"), as described in the Privacy Policy.
Claiming a First Discovery in the browser version requires a free account, because the claim writes a permanent public attribution. You may create one by signing in through Google, Apple, GitHub or Discord; we receive a stable identifier from that provider and, where the provider supplies it, an email address, which is used only to help you recover the account and is never shown to other players. You then choose a crafter name, which IS shown publicly beside every word you discover first. The name is checked automatically and cannot be changed afterwards, because the attributions it carries are permanent. The iPhone and Android apps have no accounts and no chosen names of any kind.
The browser version is free to play. The iPhone and Android apps, when released, are a one-time purchase (announced at $2.99) with no advertising and no subscriptions; billing and refunds for app-store purchases are handled by the store you bought from, under that store's terms. Game updates are free. If any of this ever changes, these Terms will be updated first and the change announced.
3. Your license to play

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. This license exists as long as you follow these Terms. You may not sell, rent, copy at scale, or commercially exploit the Service or its content, except for the ordinary sharing the game is built for, meaning screenshots, clips, streams and posts about your play are welcome.
4. Ownership

The Service, including the world of ideas, the recipes and world data, the software, the liquid interface, the shader-rendered artwork, the sounds, and the FusionCraft name and marks, is owned by Tobie LLC or its licensors and is protected by intellectual-property law. No rights are transferred to you except the license above.
If you send us feedback or ideas, you agree we may use them without restriction or compensation, because it is the only practical way suggestions can flow into a game.
5. First Discoveries

When you are the first player in the world to craft a word, the Service records that fact on the global ledger and displays your derived display name with that word, permanently and publicly. That permanence is the point of the game, and by playing you agree to it: you grant us the right to record, display and keep displaying that attribution as part of the shared world, for as long as the world exists, including in later seasons, archives, and promotion of the game.
A First Discovery is attribution, not property. It has no monetary value, cannot be bought, sold, traded or transferred, and does not give you any ownership of the word, the world, or the Service. You may request that your discoveries be disconnected from your identifier at any time, as described in the Privacy Policy, and the ledger entry remains, anonymized.
Claims obtained by exploiting bugs, automation, or other violations of these Terms are void, and we may re-attribute or anonymize them to protect the integrity of the ledger.
6. Fair play

The shared world only works if every first was actually found by a person playing. You agree not to:
- use bots, scripts, macros or any automation to play, claim discoveries, or interact with the Service;
- exploit bugs to gain claims or advantage (found a bug? tell us: legal@playfusioncraft.com);
- probe, overload, disrupt or interfere with the Service or other players' use of it, or access it by any means we did not provide (reasonable, non-disruptive reading of public pages is fine);
- reverse engineer or copy non-public parts of the Service except where the law expressly permits it despite this clause;
- misrepresent an affiliation with us, or use the Service in violation of any applicable law.
7. Seasons, changes and availability

FusionCraft is a live, seasonal game. Worlds are finite by design, seasons complete, and new seasons open with new worlds. We may add, change, suspend or remove features, rebalance the world between seasons, or discontinue some or all of the Service at any time, with or without notice. We do not promise the Service will always be available, uninterrupted, or error-free.
Ledger permanence means we will not casually erase attributions, but it is a design commitment about how the game works while it exists, not a legal guarantee that the Service will exist forever.
8. Privacy

Our Privacy Policy describes what the Service stores and why. The short version is that we never ask for your name, email or location, there are no third-party trackers, and nothing is sold or shared. This marketing website sets no cookies and runs no analytics; our hosting provider processes standard server logs to deliver it.
9. App stores
In plain wordsWhen you play through an app store, that store's terms also apply, and the terms Apple requires are set out in full below. (Summary only. The text below is what binds.)
If you obtain FusionCraft through an app store (the App Store and Google Play), that store's own terms also apply to your download and purchase, and these Terms operate between you and us only. Neither store is responsible for the app or for addressing any claims relating to it. Where a store's developer agreement conflicts with these Terms, that agreement governs the store's relationship with us, and nothing here reduces a right that agreement gives you.
Terms required by Apple. These apply to the iOS app obtained from the App Store, and Apple requires that we state them:
- Acknowledgement. These Terms are concluded between you and Tobie LLC only, and not with Apple. Tobie LLC, not Apple, is solely responsible for FusionCraft and its content.
- Scope of licence. Your licence is a non-transferable licence to use FusionCraft on any Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. Tobie LLC is solely responsible for providing any maintenance and support services, as specified in these Terms or as required by law. Apple has no obligation whatsoever to furnish any maintenance and support services.
- Warranty. Tobie LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If FusionCraft fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are Tobie LLC's sole responsibility.
- Product claims. Tobie LLC, not Apple, is responsible for addressing any claims relating to FusionCraft or your possession and use of it, including product liability claims, any claim that it fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property. If a third party claims that FusionCraft or your possession and use of it infringes their intellectual property rights, Tobie LLC, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Contact. Questions, complaints or claims about FusionCraft go to Tobie LLC at legal@playfusioncraft.com.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using FusionCraft.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Google Play. The Google Play Developer Distribution Agreement governs our relationship with Google and supersedes anything here that conflicts with it. Google is the merchant of record for purchases made through Google Play and may grant a full refund of the purchase price if you request one within 48 hours of purchase. Tobie LLC remains solely responsible for support and for any complaint about the app itself.
10. Buying, refunds and your statutory rights

FusionCraft is free to play in a web browser. On iPhone and Android it is a one-time purchase of $2.99 with no ads, no subscriptions, free updates. There is nothing else to buy: no subscription, no currency, no consumable, and a First Discovery is not for sale at any price.
We are not the seller. Apple and Google are the merchants of record for app purchases. We never see, hold or process your payment details. Refunds are requested from the store you bought from, under that store's policy, and we cannot issue one on their behalf. Google Play allows a full refund within 48 hours of purchase; Apple requests go through Apple Support.
Your statutory rights stand. Nothing in these Terms removes or limits a right you have under the law where you live that cannot be waived by agreement. For consumers in the EU, the EEA or the UK, that includes statutory withdrawal and conformity rights for digital content; because the store is the seller, you exercise those against the store. If any part of these Terms conflicts with a non-waivable consumer right, that right wins and the rest of these Terms still applies.
11. Age

FusionCraft is intended for players aged 13 and over and is not directed at children under 13. If you are under the age of majority where you live, use it only with the involvement of a parent or guardian who agrees to these Terms.
The design does most of the work here. There is no messaging between players and no free-text profile. In the iPhone and Android apps there are no accounts at all and the name shown beside a first discovery is generated by the game rather than typed. In the browser, claiming a first requires an account and a chosen crafter name; that name is the only text a player can publish, it is limited to letters, numbers, hyphens and underscores, and it is screened automatically before it is accepted. What the Service stores is described in the Privacy Policy.
12. Suspension and ending

You may stop using the Service at any time; deleting the app or leaving the site ends your use, and the Privacy Policy explains what stays and what you can have anonymized. We may suspend or block access, including voiding claims under the First Discoveries section, where we reasonably believe these Terms are being violated.
Sections that by their nature should survive (Ownership, First Discoveries, Disclaimers, Limitation of Liability, Disputes, Governing Law, General) survive any end of your use of the Service.
13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT ANY CONTENT IS ACCURATE, OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TOBIE LLC AND ITS OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL OR PROFITS, ARISING FROM OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF FIFTY U.S. DOLLARS (US$50) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
15. Indemnification

You agree to indemnify and hold Tobie LLC harmless from claims, damages and reasonable legal fees arising out of your violation of these Terms or misuse of the Service, to the extent permitted by applicable law.
16. Disputes and arbitration

Informal resolution first. Before filing any claim, email legal@playfusioncraft.com with a description of the dispute. Most disputes are resolved quickly and personally. Both sides agree to try in good faith for 30 days before formal proceedings.
Arbitration. Any dispute not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may (a) bring an individual claim in small-claims court, or (b) seek injunctive relief in court for infringement or misuse of intellectual property.
No class actions; jury waiver. Disputes will be resolved only on an individual basis; class actions, class arbitrations and representative proceedings are waived, and both parties waive any right to a jury trial. If the class waiver is found unenforceable as to a particular claim, that claim (and only that claim) proceeds in court.
Opt-out. You may opt out of this arbitration section entirely by emailing legal@playfusioncraft.com within 30 days of first accepting these Terms, stating that you opt out of arbitration. Opting out does not affect any other section.
17. Governing law

These Terms and any dispute arising out of them are governed by the laws of the State of Oregon, without regard to conflict-of-law rules, except where the law of your place of residence gives you non-waivable consumer protections.
18. Changes to these terms

We may update these Terms as the Service evolves. The "last updated" date at the top will change with any revision, and material changes will be announced in the game or on this site before they take effect. Continuing to use the Service after changes take effect means you accept the revised Terms.
19. General

We may assign these Terms in connection with a merger, acquisition, reorganization, or conversion of corporate form (including a conversion of Tobie LLC to a corporation), or a sale of assets; they bind and benefit successors and permitted assigns. You may not assign them. If any provision is found unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. Our not enforcing a provision is not a waiver of it.
